Sensitive information

Information that you choose to record in a Laterhood Plan or Message for Later may reveal information concerning health, disability, religious or philosophical beliefs, sexual orientation or other information protected as special category data.

Health information is expressly treated as special-category information under UK GDPR.

Where Laterhood asks you to provide optional special-category information and relies upon consent to process it, we will seek explicit consent as required. You may withdraw that consent, subject to processing that is required for another lawful reason.

We will not intentionally require more sensitive information than is reasonably necessary for the relevant Laterhood feature.

Why we use personal information

We may use personal information to:

  • create and administer accounts;
  • provide the Laterhood service;
  • store and maintain Laterhood Plans;
  • operate Trusted Person arrangements;
  • process check-ins and notifications;
  • store and release Messages for Later according to selected arrangements;
  • administer memberships and payments;
  • provide the professional directory;
  • respond to enquiries;
  • prevent fraud and protect account security;
  • diagnose technical problems;
  • comply with legal obligations;
  • understand and improve use of the website; and
  • provide marketing where permitted.

The ICO requires privacy information to identify purposes, lawful bases, recipients, retention arrangements and relevant individual rights.

Our lawful bases

Depending on the processing, we rely upon:

Contract - where processing is necessary to provide a Laterhood service you have requested.

Legal obligation - where we need to process information to comply with applicable law.

Legitimate interests - for purposes such as protecting the service, preventing fraud, maintaining security, responding to enquiries and improving Laterhood where those interests are not overridden by your rights.

Consent - where you have made a genuine choice, including certain marketing, analytics/cookie activities and, where appropriate, special-category information.

Where special-category information is processed, we will also identify an applicable Article 9 condition. The ICO confirms that an Article 6 lawful basis alone is not sufficient for such data.

Information about other people

Laterhood allows you to provide information about other people, including Trusted People and message recipients.

You should only provide information that is reasonably necessary and that you are entitled to provide.

We may contact those individuals where necessary to provide the Laterhood service, for example to invite a Trusted Person or deliver a message.

Who receives your information

We do not sell your personal information.

Information may be processed by service providers necessary to operate Laterhood, including:

  • hosting and server infrastructure providers;
  • Stripe for payment processing;
  • Google services, including analytics where enabled;
  • Meta where Meta Pixel or related technology has been consented to and enabled;
  • email and communications infrastructure;
  • professional advisers where necessary; and
  • public authorities where disclosure is legally required.

Your information may also be disclosed to Trusted People or message recipients only in accordance with the relevant Laterhood functionality, permissions and release arrangements, except where disclosure is otherwise legally required.

Hosting

Laterhood is currently hosted using infrastructure supplied by Unlimited Web Hosting and administered through the hosting environment used for Laterhood.

Transactional email is currently sent through the Laterhood hosting environment.

Analytics and advertising technology

With the appropriate cookie permissions, we may use Google Analytics to understand website usage and Meta Pixel to measure advertising and website activity.

Google Search Console may also be used to monitor the website's performance in Google Search.

Non-essential tracking technologies will not be intentionally activated before the required cookie choice has been made.

International transfers

Some third-party technology providers may process information outside the United Kingdom.

Where personal data is transferred internationally, we will use an applicable lawful transfer mechanism, such as UK adequacy regulations or appropriate contractual safeguards, where required.

How long we keep information

We keep personal information only for as long as reasonably necessary for the purpose for which it was collected and to meet legal, accounting, security and dispute-resolution requirements.

Account information and active Laterhood content will generally be retained while your account remains active.

Following account closure, information will be deleted or anonymised after an appropriate period unless it needs to be retained for legal, security, financial or dispute purposes.

Payment and transaction records may need to be retained for longer to meet tax and accounting requirements.

Backups may retain deleted information temporarily until they cycle out in accordance with normal backup procedures.

Security

We use appropriate technical and organisational measures designed to protect personal information against unauthorised access, alteration, disclosure, loss or destruction.

However, no internet-based system can guarantee absolute security.

You are responsible for protecting your account password and should contact us promptly if you believe your account has been compromised.

Your rights

Depending on the circumstances, UK data protection law may give you rights to:

  • access your personal information;
  • correct inaccurate information;
  • request deletion;
  • restrict processing;
  • object to certain processing;
  • receive certain information in a portable format; and
  • withdraw consent where processing is based on consent.

To exercise a right, contact hello@laterhood.com.

You also have the right to complain to the UK Information Commissioner's Office.

Changes to this policy

We may update this Privacy Policy as Laterhood develops or legal requirements change. The latest version will be published on the website with its revision date.
