Terms & Conditions of Membership

1. About these Terms
These Terms and Conditions govern your use of Laterhood and your membership of the Laterhood service.
Laterhood is a trading name of Claire Haas, a sole trader, of 95 Toronto Road, Portsmouth, Hampshire, PO2 7QD, United Kingdom.

By creating a Laterhood account, purchasing a membership or continuing to use the service, you agree to these Terms.
You must be aged 18 or over to create an account.
2. What Laterhood is
Laterhood is an online planning service designed to help adults make and record practical arrangements for later life, particularly those who may not have adult children or other family members they expect to rely upon.
Depending on your membership and the features available, Laterhood may allow you to:
- create and maintain a Laterhood Plan;
- nominate Trusted People;
- set up check-ins and notifications;
- create Messages for Later;
- record information and instructions;
- find professionals through the Laterhood professional directory; and
- use other planning and communication tools provided by Laterhood.
Features may vary between membership plans and may change as the service develops.
3. Laterhood is not an emergency service
Laterhood is not an emergency, medical monitoring, personal alarm or emergency-response service.
You must not rely upon Laterhood as a substitute for calling 999, contacting the emergency services, obtaining medical assistance, using a monitored personal alarm service or making other appropriate emergency arrangements.
A missed Laterhood check-in does not establish that you are ill, injured, incapacitated, missing or have passed away.
Laterhood does not independently investigate your circumstances following a missed check-in.
If you require emergency monitoring or guaranteed emergency intervention, you should use an appropriate specialist service.
4. Your Laterhood Plan
Your Laterhood Plan is a personal planning and information tool.
It is not a will, power of attorney, advance decision, trust, contract or other legal document, and it does not replace professional legal, medical, financial or other advice.
Information or wishes recorded in your Laterhood Plan may help people understand your preferences and arrangements, but recording something in Laterhood does not necessarily make it legally binding.
You are responsible for obtaining appropriate professional advice and for putting legally effective documents in place where necessary.
5. Your responsibilities
You are responsible for:
- providing accurate information;
- keeping your account information up to date;
- keeping your password and login details secure;
- maintaining accurate contact details for your Trusted People and message recipients;
- reviewing your Laterhood Plan periodically;
- ensuring your chosen arrangements remain appropriate;
- obtaining permission where appropriate before providing another person's personal information to Laterhood; and
- deciding whether Laterhood is suitable for your circumstances.
You must not deliberately provide false or misleading information or use Laterhood for unlawful, fraudulent, abusive or harmful purposes.
6. Trusted People
You may be able to nominate one or more adults as Trusted People, subject to the limits of your membership.
A Trusted Person must be aged 18 or over.
Nominating somebody does not guarantee that they will accept the role, remain willing or able to act, respond to a notification, or carry out your wishes.
You are responsible for choosing suitable Trusted People and keeping their details current.
Laterhood does not vet Trusted People or guarantee their reliability, availability, identity, conduct or suitability.
A Trusted Person does not automatically receive unrestricted access to your Laterhood Plan merely because you nominate them. Access is governed by the permissions and release arrangements available through the service.
7. Check-ins
Laterhood may allow you to schedule check-ins.
Check-ins are intended as a planning and notification feature. They are not a safety guarantee or emergency monitoring service.
Scheduled messages may be processed within a delivery window rather than at an exact minute. Email, SMS, WhatsApp or other communications can also be delayed or fail for reasons outside Laterhood's control.
A missed check-in may trigger reminders, notifications or other actions according to the settings available and the arrangements you have selected.
You remain responsible for selecting appropriate settings and ensuring that your Trusted People understand what you would like them to do.
8. Messages for Later
Messages for Later allows eligible members to prepare messages for people they choose, for release through the arrangements offered by Laterhood.
You are responsible for the content of your messages and for keeping recipient contact details accurate.
Laterhood cannot guarantee that:
- a recipient's contact details will still be valid;
- a recipient will receive a message;
- an email or other communication will not be filtered or blocked;
- a recipient will open or read a message; or
- a recipient will act upon its contents.
Messages must not contain unlawful, threatening, abusive, defamatory or otherwise prohibited content.
9. Professional directory
Laterhood may provide a directory of independent professionals and businesses.
Directory profiles are provided by the professional members themselves unless expressly stated otherwise.
A listing does not constitute endorsement, accreditation, approval or a recommendation by Laterhood.
Laterhood does not guarantee the qualifications, licensing, insurance, competence, suitability, availability, prices or quality of any listed professional.
You should make your own enquiries and check that a professional and their services are suitable for your needs before engaging them.
Any agreement you enter into with a professional is between you and that professional.
10. Membership plans
Laterhood may offer Free, Premium, Connect or other membership plans.
The features, limits and prices applicable to each plan will be displayed before you subscribe.
Paid memberships may renew automatically at the applicable monthly or annual interval unless cancelled.
Prices may change. We will provide appropriate notice before a price change affects an existing recurring subscription where required.
11. Payments
Payments for paid Laterhood memberships are processed by Stripe or another payment provider identified at checkout.
Laterhood does not normally receive or store your complete payment-card details.
You agree to provide valid payment information and authorise the applicable recurring payments when purchasing a recurring membership.
12. Upgrades and downgrades
You may change membership where the service allows this.
The price, timing and effect of an upgrade or downgrade will be displayed or explained as part of the change process.
Downgrading may reduce limits or remove access to features available under your previous membership.
Where information exceeds the allowance of a lower plan, Laterhood may require you to reduce the relevant information or usage before or following a downgrade. We will not deliberately delete important member content without appropriate warning except where necessary for security, legal compliance or enforcement of these Terms.
13. Cancellation and cooling-off rights
You can cancel the automatic renewal of a paid membership through the facilities provided by Laterhood or by contacting hello@laterhood.com.
Cancelling renewal means your paid membership will normally remain available until the end of the period already paid for.
Nothing in these Terms removes any statutory cancellation or refund rights you have as a consumer.
For applicable distance service contracts, consumers generally have a statutory 14-day cancellation period. Where you expressly ask for a paid service to begin during that period, the law may permit a proportionate charge for service already supplied if the required conditions have been met.

14. Availability of Laterhood
We aim to provide a reliable service, but we cannot guarantee that Laterhood will be uninterrupted or error-free.
We may temporarily suspend access for maintenance, security, upgrades, technical problems or circumstances beyond our reasonable control.
Internet, hosting, telecommunications and third-party provider failures may also affect availability.
Because some Laterhood features are time-sensitive, you should not make Laterhood your sole means of safeguarding yourself or communicating essential information.
15. Changes to Laterhood
We may improve, replace, add or discontinue features as the service develops.
Where a material change significantly affects a paid membership, we will provide reasonable notice where practicable and where required by law.
16. Intellectual property
The Laterhood website, branding, software, design, text and other materials created by Laterhood are protected by applicable intellectual property laws.
You retain ownership of original content you enter into your account.
You give Laterhood the limited permission necessary to store, process, display and transmit that content solely as required to provide and operate the service and fulfil your selected arrangements.
17. Suspension and termination
We may suspend or terminate an account where reasonably necessary because of:
- serious or repeated breach of these Terms;
- fraud or suspected fraud;
- misuse of the service;
- security concerns;
- non-payment;
- unlawful activity; or
- a legal or regulatory requirement.
Where appropriate, we will try to provide notice and an opportunity to resolve the issue.
18. Liability
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory consumer rights.
Subject to those rights, Laterhood is not responsible for losses caused by circumstances outside our reasonable control or by your reliance on Laterhood as an emergency, medical, legal, financial or professional service when it is not provided as such.
We are not responsible for the independent acts or omissions of Trusted People, professionals, message recipients or other third parties.
19. Governing law
These Terms are governed by the laws of England and Wales.
If you are a consumer, you may also have rights under the mandatory laws applicable where you live.
